Terms and Conditions

By showing your interest in ZEMO Solutions Pty. Ltd. through your first communication by filling Form FE you signify that all terms & condition of ZEMO Solutions Pty. Ltd. are acceptable to you. If you don't agree this following terms & conditions please don't sign.

The Participant / Patient or his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient shall read carefully the terms and conditions mentioned herein before filling and signing the registration form R-F. The terms and conditions as set out in the registration form are also set out in the Package brochure, a copy of which has be provided on inquiry by anyone who is making the booking on behalf of the Participant / Patient. Then he or she shall sign the registration form R-F. The signing of the registration form R-F by the Participant/Patient shall mean acceptance in totality of the terms and conditions contained herein by the Participant / Patient.

The registration form R-F shall be binding on the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) and shall constitute a contract between ZEMO Solutions Pty. Ltd. and the Participant / Patient, signing the registration form R-F and making payment towards the Package.

1.	We hereby take it granted that by starting communication with ZEMO Solutions Pty. Ltd. on website, you agree to get bound by all policy terms and conditions contain in this agreement document of www.zemosolutions.com. ZEMO Solutions Pty. Ltd. reserves the rights to make changes at its terms of this agreement.
2.	Indemnity: You agree to protect by law, ZEMO Solutions Pty. Ltd. , it’s directors, subsidiaries, affiliates, officers, agents and other partners and employees from any loss, liability, claim or demand, including reasonably attorney fees made by any third party due to or arising out of your use of the service in violation of this agreement and / or any breach of your representation and warranties set forth above.
3.	Conflict resolution : If medical discrepancy or conflict for immutability of malpractice occurs, the legal actions carried out by the patient, all the concerned parties establish and agree that all judicial action must be carried out by the patient towards the medical professional/healthcare center/hospital only within the jurisdiction of the State of Gujarat, India, and that action will not be extended towards www.zemosolutions.com or it’s managing company ZEMO Solutions Pty. Ltd. or any of it’s directors and employees since it is a company that puts at the disposition of the patient to different professional options through listing their services without exercising / practicing medicine professionally.
4.	sputes: Hereby you agree that any kind of web site or service oriented dispute arises by using this web site the solution and governance of the dispute will be done by the laws of state of Gujarat, India without regard to its conflict of law provisions. You agree to personal jurisdiction in the state of Gujarat, India.
5.	Hospital and consultant concerns : The Hospitals and consultants shall be solely responsible for all treatments provided by them to the Participants / Patient, including surgical, medical, wellness, beauty and all related queries, opinions and complications and ZEMO Solutions Pty. Ltd. shall not be responsible for the same. It is very clear that ZEMO Solutions Pty. Ltd. doesn’t have any direct control over, administration and operation of any institution neither does it control or operate any services, facilities provided by the treating institute mentioned in the packages. ZEMO Solutions Pty. Ltd. definitely takes care in selecting all the ingredients for your packages but has no power what so ever in running the treating institutions. So ZEMO Solutions Pty. Ltd. can not be responsible or liable for any type of deficiency and delay in services / failure / unexpected adversities in proper services provided by the treatment sector of the hospital or consultants. It is also accepted by you that any type of damage injury, accidents, discomfort or death which may arrives due to any act of negligence of mark in services of the management or employees of the hospitals will not have any liability or responsibility or concern with ZEMO Solutions Pty. Ltd.
6.	For development of any emergency or complication during treatment or any medical requirement, of whatsoever nature, arising with regard to the Participant / Patient’s treatment due to the Participant/Patient’s present or past illness or the side effects / allergy of / to drugs or lack of adequate treatment, pre, during or post treatment will be the absolute responsibility of the treating institution and / or the treating Doctor, as the case may be, and ZEMO Solutions Pty. Ltd. shall not be responsible for the same.
7.	If patients or his / her relatives or participants does not mention or with held any important medical information which results in damage to the treatment, ZEMO Solutions Pty. Ltd. shall not be responsible the same. If because of negligence of Hospital management or treating doctor, important medical information is not asked, it will be the absolute responsibility of the Treating Institution and / or the treating Doctor, as the case may be, and ZEMO Solutions Pty. Ltd. shall not be responsible for the same.
8.	In case the Treating Institution and / or the treating Doctor is not competent in handling a particular emergency or complication arising pre, during or post treatment of the Participant / Patient, it shall be the absolute responsibility of the Treating Institution and / or the treating Doctor, as the case may be, to refer or call upon the competent medical authority, after taking the consent of the Participant / Patient or his / her family members / relatives / escorts / friends and ZEMO Solutions Pty. Ltd. shall not be responsible for the same.
9.	It shall be the absolute responsibility of the Treating Institution and / or the treating Doctor, as the case may be, at the time of the Participant / Patient’s admission to apprise him / her or his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient of the possibility of Contingency Expenses (howsoever rare) and secure his / her consent or the consent his / her family members / relatives / escorts / friends in writing to pay for or assist the Treating Institution to recover from the insurance company all the Contingency Expenses and ZEMO Solutions Pty. Ltd. shall not be responsible for the same.
10.	For any diversions or extension or change in line of treatment, duration or treatment and dates of treatment the treating institution or the doctor shall be solely responsible for this change, as the case may be and and ZEMO Solutions Pty. Ltd. shall not be responsible for the same.
11.	If the Participant / Patient (and his / her family members / relatives / escorts / friends making the booking on behalf of the Participant / Patient) has any complaint in respect of the services rendered by the Treating Institution, he / they should forward such complaints directly to the Treating Institution without any recourse to ZEMO Solutions Pty. Ltd.
12.	All of which is to say in medical world ~ indeed, any surgery or other invasive medical procedure ~ is not to be undertaken lightly. If you want or need a medical procedure that might be performed less expensively or more quickly overseas, do your homework ~ especially when it comes to the accreditation and quality standards of hospitals you are considering and the training and certification of doctors who would treat you.
